Please read these Terms of Service (“Terms”) carefully before using the website located at bigelowsafety.com (the “Site”) or placing an order with us. These Terms constitute a legally binding agreement between you and Legacy Supply and Distribution LLC, doing business as Bigelow Safety (“Bigelow Safety,” “we,” “us,” or “our”).

By accessing or using the Site, placing an order, or otherwise doing business with us, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

Bigelow Safety is an authorized USA distributor of The Buddie System, a wireless emergency alert system designed for crane operators, riggers, and industrial safety applications. We are operated by Legacy Supply and Distribution LLC, a company registered in the United States.

2. Eligibility

By using the Site or placing an order, you represent and warrant that:

You are at least 18 years of age
You have the legal authority to enter into a binding contract
You are using the Site for lawful purposes only
The information you provide to us is accurate and complete

Our products are intended for professional and commercial use in occupational safety applications. By purchasing, you represent that you or your organization are the intended end user and that the products will be used in accordance with all applicable safety regulations and manufacturer guidelines.

3. Products and Product Descriptions

We make every effort to accurately describe the products available on our Site. However, we do not warrant that product descriptions, specifications, pricing, or other content is error-free, complete, or current. We reserve the right to correct any errors and to update or discontinue products at any time without notice.

Bigelow Safety is an authorized distributor, not the manufacturer, of The Buddie System. Product specifications, certifications, and performance characteristics are established by the manufacturer. It is your responsibility to verify that any product meets the regulatory, safety, and operational requirements applicable to your specific use case before purchase.

Images displayed on the Site are for illustrative purposes only and may not perfectly represent the actual product.

4. Orders and Acceptance

Placing an order on our Site constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is not confirmed until you receive an order confirmation email from us. We may cancel or refuse an order if:

A product is out of stock or discontinued
There is an error in pricing or product description
We are unable to verify payment or shipping information
We have reason to believe the order is fraudulent or violates these Terms

If we cancel an order after payment has been processed, we will issue a full refund using the original payment method.

5. Pricing and Payment

All prices are listed in U.S. dollars (USD) and are subject to change without notice. Applicable taxes and shipping fees will be calculated and displayed at checkout prior to your completing a purchase.

We accept payment via the methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the payment method provided. All transactions are processed through secure, PCI-compliant payment processors. We do not store your full credit card details on our servers.

We reserve the right to correct pricing errors. If a product is listed at an incorrect price, we will notify you before processing your order and give you the option to proceed at the correct price or cancel.

6. Shipping and Delivery

We ship within the United States. Estimated delivery times are provided at checkout and are estimates only — we are not responsible for delays caused by carriers, weather, customs, or other circumstances beyond our control.

Risk of loss and title for products pass to you upon delivery to the carrier. If your order is lost or damaged in transit, please contact us at sales@bigelowsafety.com and we will work with you to resolve the issue.

It is your responsibility to provide an accurate and complete shipping address. We are not responsible for orders delivered to an incorrect address provided by the customer.

7. Returns and Refunds

We want you to be satisfied with your purchase. Our return policy is as follows:

Returns must be requested within 30 days of delivery
Items must be unused, in original condition, and in original packaging
To initiate a return, contact us at sales@bigelowsafety.com or via our contact form to obtain a return authorization
Return shipping costs are the responsibility of the customer unless the return is due to our error or a defective product
Refunds will be issued to the original payment method within 10 business days of receiving and inspecting the returned item

Products that have been used, installed, altered, or damaged after delivery are not eligible for return. We reserve the right to deny returns that do not meet the above conditions.

8. Warranties

Manufacturer Warranty. The Buddie System products may be covered by a warranty provided by the manufacturer. Warranty terms, coverage, and claims processes are governed by the manufacturer and are separate from any commitments made by Bigelow Safety. Please refer to the documentation included with your product or contact us for manufacturer warranty information.

Distributor Disclaimer. Bigelow Safety makes no independent warranties beyond those expressly provided by the manufacturer. To the fullest extent permitted by applicable law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Bigelow Safety and Legacy Supply and Distribution LLC, and their officers, employees, agents, and suppliers, shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Damages arising from product misuse, improper installation, or failure to follow manufacturer guidelines or applicable safety regulations
Damages arising from reliance on any information on the Site

In no event shall our total liability to you for any claim arising out of or related to these Terms or your use of our Site or products exceed the amount you paid to us for the specific product giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

10. Safety and Proper Use

The Buddie System and related products are safety-critical devices intended for use in industrial and occupational environments. You acknowledge and agree that:

It is your sole responsibility to ensure that products are installed, tested, maintained, and operated in strict accordance with the manufacturer’s instructions and all applicable federal, state, and local safety regulations
Bigelow Safety makes no representation that the purchase or use of any product satisfies any specific regulatory, OSHA, or compliance requirement applicable to your operations
No safety device eliminates risk entirely, and the products are intended to supplement — not replace — proper safety training, procedures, and oversight
You are responsible for ensuring that all personnel who use or are affected by the product are properly trained

11. Intellectual Property

All content on the Site, including text, images, logos, graphics, product descriptions, and other materials, is the property of Bigelow Safety, Legacy Supply and Distribution LLC, or their respective licensors (including the manufacturer of The Buddie System), and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission. Nothing in these Terms grants you any license or right to use any trademark, trade name, or logo displayed on the Site.

12. Acceptable Use

When using our Site, you agree not to:

Use the Site for any unlawful purpose or in violation of any applicable laws or regulations

If negotiation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Maine, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.

You agree that any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative action.

16. Indemnification

You agree to indemnify, defend, and hold harmless Bigelow Safety, Legacy Supply and Distribution LLC, and their officers, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of the Site or purchase of products
Your violation of these Terms
Your violation of any applicable law or regulation
Your misuse of any product purchased from us
Any third-party claim arising from your actions

17. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. The revised Terms will be posted on this page with an updated effective date. Your continued use of the Site following the posting of changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

18. Severability
